§ 1 Guarantor

§ 2 Scope of the warranty

The guarantor grants the purchaser a voluntary manufacturer’s warranty on the R3 series automatic hose reels (DR 100-R3, DR 200-R3, DR 300-R3, AR 100-R3, AR 200-R3) for a period of 60 months from the date of purchase.

The warranty covers defects that can be proven to be due to material or manufacturing faults and which either existed at the time of transfer of risk or arose during the warranty period.

§ 3 Exclusions

The following are expressly excluded from the warranty:

a) Wear and tear

Damage or malfunctions resulting from normal wear and tear arising from use in accordance with the intended purpose. In the case of the hose reel, this includes in particular:

  • Hose (porosity, cracks, hardening due to UV exposure or weathering)
  • Sealing rings, O-rings and hose connections
  • Reel-up mechanism (springs, locking mechanism) under normal use
  • Bearings and swivel joints of the drum
  • Plastic parts (embrittlement, fading due to weathering)
  • Coatings and surfaces of the housing

b) Own fault and improper handling

Damage caused by:

  • improper or unauthorised use
  • incorrect assembly or installation by the purchaser or third parties
  • failure to follow the operating instructions or safety guidelines
  • unauthorised modifications, alterations or attempted repairs
  • external factors such as vehicles driving over the hose, frost, kinking, mechanical damage or force majeure

c) Transport costs

The costs of transporting the product to the warranty provider or a service centre designated by them shall be borne by the purchaser. The same applies to packaging and insurance costs associated with the return shipment. The costs of returning the product once the warranty claim has been settled shall be borne by the warranty provider.

d) Commercial use

This warranty applies exclusively to private end users. Damage or defects arising in connection with commercial, professional or any other non-private use of the product are excluded from the warranty. Commercial use includes, in particular, use in businesses, public authorities, clubs, rental schemes or for other commercial purposes.

In order to make a claim under the warranty, the purchaser is obliged to:

  • notify the warrantor of the defect in writing or by email within 14 days of discovery;
  • provide proof of purchase (e.g. receipt or invoice);
  • return the product at their own expense (see § 3 c).

A delayed notification of a defect does not result in the loss of the warranty claim, provided that it can be proven that the defect arose within the warranty period and the delay is not attributable to the buyer.

§ 5 Warranty cover

In the event of a claim under the warranty, the warrantor shall, at its sole discretion, decide on:

  • Repair of the product,
  • supply of an equivalent replacement product, or
  • refund of the purchase price.     

The purchaser has no right to a specific type of warranty service.

Making a claim under the guarantee – whether through repair or the supply of a replacement product – does not extend or renew the original guarantee period. The original date of purchase remains the decisive factor in all cases.

§ 6 Relationship to the statutory warranty

This guarantee does not affect the purchaser’s statutory warranty rights against the seller under Sections 434 et seq. of the German Civil Code (BGB). These rights exist independently of this guarantee and are neither restricted nor replaced by it.

§ 7 Miscellaneous

This warranty is governed by the law of the Federal Republic of Germany. The place of performance is the guarantor’s registered office.
Should any provision of these warranty terms be or become invalid, this shall not affect the validity of the remaining provisions.
